Placing Orders for Goods
By placing an Order for Goods through the Service, You warrant that You are legally capable of entering into binding contracts.

Order Cancellation by Us
We reserve the right to refuse or cancel Your Order at any time for certain reasons including but not limited to:
1. Goods availability;
2. Errors in the description or prices for Goods;
3. Errors in Your Order;
4. Suspected fraud, unauthorized transaction, or otherwise illegal transaction
Order Cancellation by You
Any Goods you purchase can only be returned in accordance with these Terms and Conditions and Our Returns Policy.
Our Returns Policy forms a part of these Terms and Conditions. Please read our Returns Policy to learn more about your right to cancel Your Order.
Your right to cancel an Order only applies to non-perishable Goods. Non-perishable goods that are returned in the same condition as You received them and within 30 days of the date of purchase. You should also include all of the products instructions, documents and wrappings. Goods that are perishable, are damaged, or not in the same condition as You received them or which are worn simply beyond opening the original packaging will not be refunded. You should therefore take reasonable care of the purchased Goods while they are in Your possession.
We will reimburse You no later than 30 days from the day on which We receive the returned Goods. We will use the same means of payment as You used for the Order, and You will not incur any fees for such reimbursement. You will be responsible for any and all shipping costs
Orders for perishable Goods which require a deposit to reserve this product for future delivery and full payment made by You, including orders for ¼ , ½ , or whole animal carcass, are cancellable up to 30 days before the stated availability date at time of order, however, a refund of any deposit made will only be made if the cancellation occurs at least 90 days prior to the butcher date of any given animal. If a cancellation is made less than 90 days prior to the butcher date of any given animal, any deposits paid shall be forfeited.
Availability, Errors and Inaccuracies
We are constantly updating Our offerings of Goods on the Service. The Goods available on Our Service may be mispriced, described inaccurately, or unavailable, and We may experience delays in updating information regarding our Goods on the Service and in Our advertising on other websites.
We cannot and do not guarantee the accuracy or completeness of any information, including prices, product images, specifications, availability, and services. We reserve the right to change or update information and to correct errors, inaccuracies, or omissions at any time without prior notice.
Pricing Policy
The Company reserves the right to revise its prices at any time prior to accepting an Order.
The prices quoted may be revised by the Company subsequent to accepting an Order in the event of any occurrence affecting delivery caused by government action, variation in customs duties, increased shipping charges and/or delivery fees, higher foreign exchange costs and any other matter beyond the control of the Company. In that event, You will have the right to cancel Your Order.
Payments
Goods may be paid for either by (1) a one-time payment at point of sale, or (2) by a deposit made at point of sale with full payment to be made upon delivery of Goods at a future date. The manner of payment, in all cases, shall be entirely in our discretion. Payment can be made through various payment methods we have available, such as cash, check, Visa, MasterCard, Affinity Card, American Express cards or online payment methods (PayPal, for example).
Payment cards (credit cards or debit cards) are subject to validation checks and authorization by Your card issuer. If we do not receive the required authorization, We will not be liable for any delay or non-delivery of Your Order.
Goods for which We require a deposit at point of sale and full payment upon delivery are typically used for Goods which we do not carry inventory on hand. For these Goods, we will provide an approximation of the expected price to be paid upon delivery at the point of sale. This approximation will be made by using the current market price of the Goods multiplied by the estimate weight of the Goods. You agree that actual amount to be paid upon delivery of the Goods will be the current market price at time of delivery multiplied by the actual weight or the Goods upon delivery less any amounts paid as a deposit
Refunds
Certain refund requests may be considered by the Company on a case-by-case basis and granted at the sole discretion of the Company.
Promotions
Any Promotions made available through the Service may be governed by rules that are separate from these Terms.
If You participate in any Promotions, please review the applicable rules as well as our Privacy policy. If the rules for a Promotion conflict with these Terms, the Promotion rules will apply.
User Accounts

Messaging Specific Terms & Conditions
This SMS message program is a service of our Company. By providing your cell phone number, you agree to receive recurring automated promotional and personalized marketing text messages (e.g., SMS/MMS cart reminders, sale notices, etc) from the Company. These messages include text messages that may be sent using an automatic telephone dialing system, to the mobile telephone number you provided when signing up or any other number that you designate. You give Us permission to send text messages to the enrolled cell phone number through your wireless phone carrier, unless and until you end permission per these Terms & Conditions. Consent to receive automated marketing text messages is not a condition of any purchase. Message & data rates may apply.
Message frequency may vary. We reserve the right to alter the frequency of messages sent at any time, so as to increase or decrease the total number of sent messages. We also reserve the right to change the short code or phone number from which messages are sent

Cancellation of Messaging

After texting STOP to the telephone number, long code, or short code that sends you our initial confirmation message you will receive one additional message confirming that your request has been processed. If you change your preferences, you should be opted out of receiving text messages immediately but there could be a delay in processing that request. You acknowledge that our text message platform may not recognize and respond to unsubscribe requests that do not include the STOP keyword command and agree that our Company and its service providers will have no liability for failing to honor such requests. If you unsubscribe from one of our text message programs, you may continue to receive text messages from Us through any other programs you have joined until you separately unsubscribe from those programs.

Text the keyword HELP to the telephone number, long code, or short code that sends you our initial confirmation message to receive a text with information on how to unsubscribe.
Limitation of Liability
Notwithstanding any damages that You might incur, the entire liability of the Company and any of its suppliers under any provision of this Terms and Your exclusive remedy for all of the foregoing shall be limited to the amount actually paid by You through the Service or 100 USD if You haven't purchased anything through the Service.
To the maximum extent permitted by applicable law, in no event shall the Company or its suppliers be liable for any special, incidental, indirect, or consequential damages whatsoever (including, but not limited to, damages for loss of profits, loss of data or other information, for business interruption, for personal injury, loss of privacy arising out of or in any way related to the use of or inability to use the Service, third-party software and/or third-party hardware used with the Service, or otherwise in connection with any provision of this Terms), even if the Company or any supplier has been advised of the possibility of such damages and even if the remedy fails of its essential purpose.

TO THE MAXIMUM EXTENT ALLOWED BY APPLICABLE LAW, YOU ACKNOWLEDGE AND AGREE THAT THE SEVICES PROVIDED BY US ARE ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED.
Limitation of Liability
TO THE MAXIMUM EXTENT ALLOWED BY APPLICABLE LAW, YOU AGREE THAT IN NO EVENT SHALL CHAMPLIN’S SUGAR CREEK FARM, LLC OR ANY PARTY ACTING ON BEHALF OF CHAMPLIN’S SUGAR CREEK FARM, LLC BE LIABLE FOR: (A) ANY CLAIMS, PROCEEDINGS, LIABILITIES, OBLIGATIONS, DAMAGES, LOSSES OR COSTS IN AN AGGREGATE AMOUNT EXCEEDING THE GREATER OF THE AMOUNT YOU PAID TO CHAMPLIN’S SUGAR CREEK FARM, LLC HEREUNDER OR $100.00; OR (B) ANY DIRECT, INDIRECT, CONSEQUENTIAL, SPECIAL, INCIDENTAL, PUNITIVE OR ANY OTHER DAMAGES. YOU AGREE EVEN IF CHAMPLIN’S SUGAR CREEK FARM, LLC HAS BEEN TOLD OF POSSIBLE DAMAGE OR LOSS ARISING OR RESULTING FROM OR IN ANY WAY RELATING TO YOUR USE OF CHAMPLIN’S SUGAR CREEK FARM, LLC SERVICES. CHAMPLIN’S SUGAR CREEK FARM, LLC AND ITS REPRESENTATIVES ARE NOT LIABLE FOR THE ACTS OR OMISSIONS OF THIRD PARTIES.
Indemnity
To the maximum extent allowed by applicable law, you agree to indemnify, defend and hold harmless Champlin’s Sugar Creek Farm, LLC, its directors, officers, employees, servants, agents, representatives, independent contractors and affiliates from and against any and all claims, damages, liabilities, actions, causes of action, costs, expenses, including reasonable attorneys’ fees, judgments or penalties of any kind or nature arising from or in relation to the these Terms and Conditions.
Dispute Resolution
If You have any concern or dispute about the Service, You agree to first try to resolve the dispute informally by contacting the Company.
General. Any dispute or claim arising out of or in any way related to these Terms and Conditions or Our service providers whether based in contract, tort, statute, fraud, misrepresentation, or any other legal theory, and regardless of when a dispute or claim arises will be resolved by binding arbitration. YOU UNDERSTAND AND AGREE THAT, BY USING OUR SERVICES, YOU AND CHAMPLINS SUGAR CREEK FARM, LLC ARE EACH WAIVING THE RIGHT TO A TRIAL BY JURY OR TO PARTICIPATE IN A CLASS ACTION AND THAT THESE MESSAGING TERMS SHALL BE SUBJECT TO AND GOVERNED BY ARBITRATION.
Exceptions. Notwithstanding subsection (a) above, nothing in these Terms and Conditions will be deemed to waive, preclude, or otherwise limit the right of you or Champlin’s Sugar Creek Farm, LLC to: (i) pursue an enforcement action through the applicable federal, state, or local agency if that action is available; (ii) seek injunctive relief in aid of arbitration from a court of competent jurisdiction; (iii) file suit in a court of law to address an intellectual property infringement claim.
Arbitrator. Any arbitration between you and Champlin’s Sugar Creek Farm, LLC will be governed by the JAMS, under the Optional Expedited Arbitration Procedures then in effect for JAMS, except as provided herein. JAMS may be contacted at www.jamsadr.com. The arbitrator has exclusive authority to resolve any dispute relating to the interpretation, applicability, or enforceability of this binding arbitration agreement.
No Class Actions. YOU AND CHAMPLIN’S SUGAR CREEK FARMS, LLC AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. Further, unless both you and Champlin’s Sugar Creek Farm, LLC agree otherwise in a signed writing, the arbitrator may not consolidate more than one person's claims, and may not otherwise preside over any form of a representative or class proceeding. You agree that, by agreeing to these Messaging Terms, you and Champlin’s Sugar Creek Farm, LLC are each waiving the right to a trial by jury or to participate in a class action, collective action, private attorney general action, or other representative proceeding of any kind.
Severability and Waiver
If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law and the remaining provisions will continue in full force and effect.
Except as provided herein, the failure to exercise a right or to require performance of an obligation under this Terms shall not effect a party's ability to exercise such right or require such performance at any time thereafter nor shall be the waiver of a breach constitute a waiver of any subsequent breach.
Entire Agreement
The terms found herein, together with any amendments and any additional agreements you may enter into with us in connection herewith, will constitute the entire agreement between you and Champlin’s Sugar Creek Farm, LLC.
Changes to These Terms and Conditions
We reserve the right, at Our sole discretion, to modify or replace these Terms at any time. If a revision is material We will make reasonable efforts to provide at least 30 days' notice prior to our account holders, newsletter recipients, and SMS Messaging recipients, of any new terms taking effect. What constitutes a material change will be determined at Our sole discretion.
